Terms & Conditions

1.The use of Bework, Bethera products, implies full and unconditional acceptance of all the provisions included in these Terms and Conditions of Use, as well as in the Privacy Policy of the products belonging to the company Bethera.  

2. Bethera reserves the right to periodically change the Terms and Conditions and the Privacy Policy, so the User should consult the current documents before using the service. If the User does not fully agree with their provisions, they should not use the service.

3. Any functionality that modifies, improves, or enhances the current service, including the release of new tools, is subject to the conditions set forth in the Terms and Conditions and the Privacy Policy.

4. Violation of any of the conditions set forth in the Terms and Conditions gives Bethera the right to terminate the contract and prevent the user from using the service.

RESPONSIBILITY

1. The User agrees to ensure that all information provided is true, accurate, complete, and not misleading in any substantial aspect, to use the service exclusively for the purposes described in this agreement, and to inform the Bethera team of any facts and/or circumstances that may affect, in any way, their rights or the rights of third parties, authors, or others.

2. The User agrees to make every effort, always acting with the utmost diligence in using the service, to fulfill the purposes of this agreement and not to disparage Bethera's products.

3. The User understands and agrees that Bethera cannot be held responsible for any content entered and presented during the use of the service.

4. Bethera does not acknowledge and cannot be held responsible for errors or delays that may occur due to errors attributable to the User or the system, or the failure (temporary or permanent) of applications or other tools, any data loss, delays, or any other circumstance or fact attributable to third parties or the Internet that may affect the access and/or development of the service, nor is it responsible for any damages resulting from the use or inability to use the service.

5. Bethera is not responsible for any errors that the User or their associates may make when providing their personal data, and is especially not responsible for errors that may occur in the service due to incorrect, incomplete, or erroneous information provided by the User.

6. Bethera cannot be held responsible for any loss or damage resulting from unauthorized access by third parties, with the User acknowledging that Bethera's products are equipped with all appropriate and adequate security measures to protect their data. The User agrees not to compromise the security of the system through negligent, incorrect, or inappropriate use of the system and services.

7. The User expressly understands and agrees that Bethera cannot be held liable under any circumstances for any direct, indirect, material, or immaterial damages, except in cases of intentional or fraudulent acts by Bethera. This includes, but is not limited to: damages for lost profits, damages for misuse, indirect losses, any tangible or intangible damage resulting from the use of the service, or any other damages of any kind.

8. Bethera also disclaims any responsibility for any failure or delay due to force majeure, including but not limited to, war, terrorism, state of emergency or disaster (including natural disasters), infection by computer viruses, bugs, modifications, unauthorized interventions, technical failures affecting the fulfillment of its obligations under this Agreement.

9. The User or third parties cannot hold Bethera contractually, extracontractually, criminally, or in any other way liable for any modification or alteration of prices, suspension, or termination of the service.

RESTRICTIONS ON THE USE OF BETHERA APPS

In using Bethera apps, the User agrees not to:

1. Use any mechanism, software program, or technology to interfere with or attempt to interfere with its normal operation;

2. Send or transmit to the apps any illegal, fraudulent, defamatory, or obscene information;

3. Send or transmit to the apps any information containing viruses or bugs;

4. Publish, display, distribute, create derivative works, reproduce, or use the content of the apps (excluding use expressly and previously permitted);

5. Send or transmit information that infringes on the intellectual property rights of third parties;

6. Engage in any activity that excessively overloads the infrastructure of the apps;

7. Insert, host, upload, transmit, or send unsolicited "spam" messages (understood as any email, SMS, or data entered into the system);

8. Display any part of the content of the apps using framing, links, or other technology without the express written permission of Bethera.

PAYMENTS AND REFUNDS

1. Services are billed in advance according to the contracted period (monthly or annually). There will be no right to a refund or credit if (i) the service subscription is canceled, (ii) an upgrade to the subscribed plan is made, or (iii) there are periods of non-use of the apps or non-access to the Personal Area.

2. The User must make payment for the contracted service via Multibanco reference. The prices associated with the service subscription are presented in Euros and include the applicable VAT.

3. At the time of renewal, if the amount contracted in the previous subscription is lower than the current price on the rate table, it will be subject to a maximum increase of 7%. It will be subject to a 7% increase in new renewals until it reaches the current price on the rate table.
